Terms and Conditions
STANDARD RENTAL RATES INCLUDE:
- Vehicle fully equipped with camp and safari equipment
- Unlimited miles
- Standard insurance cover
- Two drivers included
- 7 days/ 24 hours "roadside assistance"
- Airport collection and drop-off
- All applicable taxes
- Detailed introduction to vehicle and equipment
- Free border crossings in southern Africa
- Cleaning fees
- Weekend or public holiday surcharges
- All contract fees
OPTIONAL ADDITIONAL SERVICES:
- Supplemental insurance options
- Rental of Iridium or Inmarsat satellite telephones
- GPS equipment with special Africa maps preinstalled
- Driver's Training by qualified Land Rover instructors (Johannesburg only)
- Shopping service prior to arrival
- Advise on route planning
- Booking Service for reservations of parks, camps, accommodation and activities
- Assistance with regional onward bookings
RENTAL PERIOD AND COSTINGS:
- Minimum rental period is 5 days;
- Where fully equipped vehicles are supplied, the days of collection and drop-off are counted as full days irrespective of the time collected or returned;
- For vehicles without equipment we clear on 24 hour periods;
- No refunds are applicable for early returns unless arranged in advance and agreed by Kwenda Safari;
- Payment can be effected by credit card, bank transfer or cash; service charges of credit cards or bank charges in case of transfers are not included in our prices and to be borne by the client;
OFFICE HOURS:
- Monday to Fridays 08:00 to 17:00 hrs, Saturdays until 13:00 hrs;
- For our clients mobile contact numbers are available 24 hours/ 7 days a week;
- Deliveries and collections are included during normal office hours; for after hours, Sundays or public holidays we reserve the right to charge a delivery fee;

REPAIRS AND MECHANICAL FAILURES:
- Repairs of up to R3000.00 can be effected without prior authorization. On higher amounts preceding authorization
is required. Due to the vastness of the area and where the vehicle is mobile the
Hirer is responsible to get the vehicle to the nearest workshop.
- In most cases vehicles are still covered under the new vehicle manufacturers
warranty and where mechanical failures occur those warranty conditions will apply;
- Should technical failures arise, it is important to remember that Kwenda
Safari is neither the manufacturer of the vehicle nor the equipment but will always do its best to
satisfy its customers;
- Where serious mechanical failures occur due to standard wear and tear and
which cannot be resolved in commensurable time a replacement vehicle will be
sent within 24 hours of diagnosis; this relates to the countries of South
Africa, Swaziland, Lesotho, Botswana, Namibia, Zimbabwe, southern Zambia and
southern Mocambique; for countries outside this region allocation time is 72 hours;
- Inconvenience, time loss and consequential costs are not covered;
- Towing is covered for the countries of South Africa, Botswana, Namibia,
Zimbabwe, Southern Mocambique and Southern Zambia; further North towing is
covered by the Hirer.
- Mechanical failures and repair expenses in all allowed countries are covered;
COLLISION DAMAGES AND ACCIDENTS:
- All accidents must be reported to the nearest police station within 24
hours;
- Where collision damages render a vehicle unusable, a replacement vehicle can be supplied by Kwenda
Safari if available, but all costs are for the expense of the
hirer;
- In case of an accident the hirer is responsible for the return of the damaged vehicle to the company's head office;
- No refund will be given for lost days due to collision damages;
- Should the hirer decide to continue with a replacement vehicle a new rental contract and
new insurance conditions will apply;
VEHICLE INSURANCE:
- Standard insurance cover, which is comprehensive insurance is included on
all vehicles and in all rates quoted. However, this is not full cover and excess is applicable and dependant on the vehicle category.
- Insurance cover is valid in South Africa, Botswana, Namibia, Zambia,
Zimbabwe, Mocambique, Tanzania, Swaziland, Lesotho and Malawi. Special
permission is required for any other contnry in Sub Saharan Africa.
- A
double excess applies for single vehicle rollovers and single vehicle
accidents with animals at night.

Additional insurance cover is available at an extra premium which provides reduced
or zero excess for both collision, damage and theft.
- Detailed Terms and Conditions of contract and on the insurance are available and will be supplied on request;
INFORMATION AND ASSISTANCE:
Vehicles and equipment are regularly serviced and thoroughly checked
before hand-over to the client or before any guided safari. However,
should any technical problem or any other service related issues arise
while en route it is the obligation of the client to report this without
delay to our head office at the earliest possible time. This will enable
us to verify the problem, provide immediate assistance or seek any other
acceptable solution. Complaints received after return of the vehicle or
after end of the safari will be treated as irrelevant and unfair.
ROAD RESTRICTIONS:
The Kwenda Safari 4x4 vehicles are allowed on all bitumen/tar and gravel
roads as well as all recognized public tracks in South Africa, Botswana,
Namibia, Lesotho, Zimbabwe, Zambia, Mozambique, Tanzania, Swaziland,
Malawi. Special permission must be obtained for any other country in Sub Saharan Africa
(such as Angola, Kenya or Uganda)
before entering.
Vehicles are allowed to partake in Namibia Desert Tours if professionally
guided. This however is at the Hirer´s risk.
MULTIPLE RENTALS:
Multiple rentals over a reasonable period can be combined to qualify for a
favourable long rental rate. The same applies to rentals of more than one
vehicle at the same time.
CHANGE OF VEHICLE:
If for reasons beyond our control, the reserved vehicle is not available, Kwenda
Safari reserves the right to substitute the vehicle with another vehicle
of the same or higher category. This shall not constitute a breach of contract or entitle the hirer to a refund.
CANCELLATIONS:
In the event of a rental having to be cancelled, the following refund rates are applicable.
60 days or more notice: | Refund of deposit less 20% handling fee |
30-60 days notice: | Booking deposit is not refundable; if total rental has been paid upfront the balance less the deposit will be refunded |
Less than 30 days notice: | Client obligated for full rental amount; there will be no refund |
Covid-19: | Special Terms apply in case of
travel bans or restrictions which legally prevent the Hirer from travelling |
GENERAL:
The Hirer is fully responsible for any damage or related costs to the Kwenda
Safari vehicle or any third party or related hereto, if:
- The terms of the rental contract are breached;
- Damage to the vehicle or equipment caused by careless or reckless driving;

Driving under the influence of drugs or alcohol;
- Water submersion or salt-water damages;
- If the vehicle is abandoned and no immediate contact is made by the hirer to Kwenda
Safari;
- Driving on restricted or closed roads.
TRAVEL INSURANCE:
Our services do not include any travel insurances. We strongly recommend an insurance package which encompasses all insurance areas which are of relevance to travellers, such as travel cancellation, travel health,
accident and repatriation insurance or baggage insurance.
COMPANY AND LEGAL:
Domicilium citandi and executandi is South Africa; postal
address: POBox 552, Ferndale, 2160 South Africa; for any legal proceedings parties agree to
the jurisdiction of the magistrates court; the laws of South Africa shall govern the agreements.
FINAL PROVISIONS:
Rates and conditions are subject to change without notice. Same applies
to all other information provided. Dimensions and volumes shown are approximate.
